Introduction

Welcome to TestMi. These terms and conditions govern your use of the TestMi platform, a sports performance testing application designed for youth athletes and their coaches. By accessing or using TestMi, you agree to be bound by these terms.

Definitions

  • "Platform" refers to the TestMi web application and all associated services.
  • "Organisation" refers to a sports club, school, or other entity that has registered to use TestMi.
  • "User" refers to coaches, administrators, and other authorised personnel who access the platform on behalf of an organisation.
  • "Athlete" refers to individuals whose performance data is recorded on the platform.

Account responsibilities

As a user of TestMi, you agree to:

  • Provide accurate and complete information when creating your account.
  • Maintain the security of your login credentials and not share them with others.
  • Notify us immediately of any unauthorised access to your account.
  • Use the platform only for its intended purpose of recording and analysing sports performance data.

Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorised access to other users' accounts or data.
  • Upload or transmit any malicious code, viruses, or harmful content.
  • Use the platform in any way that could damage, disable, or impair its functionality.
  • Share athlete data outside of the platform without appropriate consent and authorisation.

Parental consent

TestMi is designed for use with youth athletes. Organisations are responsible for obtaining valid parental or guardian consent before recording any athlete data on the platform. The platform provides tools to facilitate this process, but the ultimate responsibility lies with the organisation.

Data ownership

Organisations retain ownership of the data they input into TestMi. By using the platform, you grant us a limited licence to store, process, and display this data as necessary to provide our services. We may also use anonymised, aggregated data to improve our platform and generate normative comparisons.

Intellectual property

The TestMi platform, including its design, features, and content (excluding user-submitted data), is owned by TestMi and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our prior written consent.

Service availability

We strive to maintain high availability of the TestMi platform, but we do not guarantee uninterrupted access. We may occasionally need to perform maintenance or updates that temporarily affect availability. We will endeavour to provide advance notice of any planned downtime.

Limitation of liability

To the fullest extent permitted by law, TestMi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you have paid to use the service in the twelve months preceding any claim.

Termination

We reserve the right to suspend or terminate your access to TestMi if you breach these terms or engage in conduct we deem harmful to other users or the platform. You may also terminate your account at any time by contacting us. Upon termination, your data will be handled in accordance with our privacy policy.

Changes to these terms

We may update these terms from time to time. We will notify users of any material changes via email or through the platform. Continued use of TestMi after such changes constitutes acceptance of the updated terms.

Governing law

These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
